GetCholo.AI Terms of Service

These Terms of Service ("Terms") govern access to and use of the GetCholo.AI platform (the "Service"), operated by COICO, LLC, with a place of business in Orlando, Florida, United States ("we", "us", or "the Company"). By creating an account or using the Service, you accept these Terms in full. If you do not agree, you must not use the Service.

1. Description of the Service

GetCholo.AI is a platform that lets you generate audiovisual content (video, image, and audio) using third-party artificial intelligence models, as well as access those capabilities through our own server compatible with the Model Context Protocol (MCP). The Service works through a credit system consumed upon successful content generation.

2. Eligibility and minimum age

You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement. We reserve the right to suspend or terminate any account that violates this condition.

3. User accounts

  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • You must provide truthful and up-to-date information when registering.
  • Notify us immediately of any unauthorized use of your account by writing to gralcoico@gmail.com.

4. Credit system and billing

  • Access to generation features is governed by a credit system, available through subscription plans (Free, Starter, Creator, Pro) or by direct purchase of additional credits.
  • Credits are only charged when a generation completes successfully. If the underlying AI provider fails to generate the requested content, the corresponding credit is not deducted or is automatically refunded.
  • In the exceptional case where the AI provider completes the generation successfully but a subsequent failure in our own infrastructure prevents delivering the result to you, you will not be charged for that generation. This guarantee covers your relationship with us as a customer; it is not a statement about our internal costs with third-party providers.
  • Payments are processed through Stripe. By providing a payment method, you accept the terms of the corresponding payment provider.
  • Subscriptions renew automatically according to the chosen billing cycle, unless cancelled beforehand.
  • Team plans distribute a shared credit pool among the members of the workspace, as described on the current pricing page.

5. User-generated content

  • You are solely responsible for the instructions (prompts), reference images, and other inputs you provide to generate content, as well as for how you use the resulting content.
  • You may not use the Service to generate content that:
    • Infringes third-party intellectual property rights, trademarks, or rights of publicity.
    • Depicts identifiable real people without their consent.
    • Constitutes child sexual abuse material, in any form.
    • Is defamatory, discriminatory, or incites violence or hatred.
    • Violates any applicable law.
  • We reserve the right to suspend accounts that violate these restrictions, without prejudice to any other legal action that may apply.
  • If you are a rights holder and believe that content infringes your rights, write to us at gralcoico@gmail.com. The procedure, the response times and our repeat-infringer policy are set out in Copyright Claims.
  • You retain ownership of the content you generate, to the extent permitted by applicable law and subject to the terms of the underlying AI model providers we use.

6. Third-party providers

The Service uses third-party infrastructure and models (including, without limitation, AI generation providers, cloud hosting, and payment processing) to operate. We do not guarantee the continued availability of any specific third-party model or feature, and we may modify, replace, or remove models as our agreements with those providers change.

7. MCP server

Access via our own MCP server is subject to the same credit limits and to additional usage-rate controls (a limit on generations per hour) described in the Service documentation, to protect your credit balance against excessive automated use.

8. Platform intellectual property

The software, design, "GetCholo.AI" brand, and other elements proprietary to the Service are owned by COICO, LLC or its licensors, and are protected by applicable intellectual property laws. These Terms do not grant you any rights over those elements, except the limited right to use the Service as set out herein.

9. Limitation of liability

To the maximum extent permitted by applicable law, COICO, LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including loss of data, revenue, or profits. The Service is provided "as is" and "as available," without warranties of any kind, express or implied.

10. Suspension and termination

We may suspend or terminate your access to the Service, with or without prior notice, if you breach these Terms or if we reasonably consider that your use poses a risk to the platform, other users, or third parties. You may cancel your account at any time from your dashboard settings.

11. Changes to the Terms

We may update these Terms from time to time. We will post the current version on this same page, indicating the date of the last update. Continued use of the Service after a change constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms will be submitted to the competent courts of Orlando, Florida.
